Abstract
This study analyzes the legality issue of Battery Electric Vehicles (BEV) subsidies, particularly Chinese BEV subsidies, is consistent with the Agreement on Subsidies and Countervailing Measures (ASCM) of the World Trade Organization (WTO). Moreover, we will assess the issue of Chinese BEV “Overcapacity” within the scope of the Anti-Dumping Agreement (ADA) and the Agreement on Safeguards (AS) of the WTO, to explore avenues for addressing this international trade issue. Our primary aim is to evaluate the issues of BEV subsidies and “Overcapacity” and to make recommendations for legal improvements within the WTO legal framework, to promote fairness and sustainability in international trade, reward innovation, and support global development and emission control.
